Since 2009, the German truck toll rates have been calculated too high, a fact confirmed by multiple rulings from the European Court of Justice (ECJ) and the Higher Administrative Court of Münster. For the period from 2009 to 2014, a refund rate of approximately 12.8%, including interest, has been confirmed.
Further proceedings are currently underway for subsequent periods, with similar refund rates expected. Recently, the Administrative Court of Cologne ruled in case 14 K 6556/20 that toll calculations from 2016-2020 also violated EU law, adding more claims to the refund pool.
